Sanef loses 'hate speech' interdict against EFF – a wry De Vos unpicks

There’s some irony in Pierre de Vos, himself among writers Julius Malema called for to be dealt with ‘decisively,’ not being consulted by the SA National Editor’s Forum (Sanef), in bringing their interdict against the populist firebrand and his cohorts.

The constitutional law expert says Sanef lost because they relied on the hate speech and harassment provisions in the promotion of Equality and Prevention of Unfair Discrimination Act. These require you to demonstrate that the person or group targeted was singled out on the basis of their race, sex, gender, sexual orientation or other prohibited ground.

Hearing the court describe Malema’s utterings as, “hurtful, distasteful and offensive” was a tiny pyrrhic victory.
